Please read these terms carefully before using HikeClock. By using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using HikeClock (“the Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be posted with an updated “Last Updated” date.

2. Description of Service

HikeClock is a web-based hiking time calculator that provides estimated hiking durations based on user-provided inputs and established mathematical formulas. The Service:

  • Calculates estimated hiking times using multiple proven formulas
  • Provides educational content about hiking time estimation methods
  • Allows users to share calculation results via shareable URLs
  • Is provided free of charge for personal, non-commercial use

3. User Responsibilities

3.1 Acceptable Use

When using HikeClock, you agree to:

  • Use the Service for lawful purposes only
  • Provide accurate information when using the calculator
  • Not attempt to interfere with, disrupt, or damage the Service
  • Not use automated tools, scripts, or bots to access the Service excessively

3.2 Safety and Decision-Making

You acknowledge and agree that:

  • Time estimates are approximations and should be used as one factor in trip planning
  • You will verify information with other sources before making hiking decisions
  • You take full responsibility for your safety and hiking decisions (see Safety Disclaimer)
  • Actual hiking conditions may differ significantly from calculated estimates

4. Limitations and Disclaimers

4.1 “As Is” Service

HIKECLOCK IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim all warranties, including but not limited to:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties regarding accuracy, reliability, or completeness of estimates
  • Warranties of uninterrupted, timely, secure, or error-free operation
  • Warranties that defects will be corrected

4.2 No Guarantee of Accuracy

While we strive for accuracy, we do not guarantee that hiking time estimates will be accurate, suitable, or appropriate for your specific situation. Many factors affect actual hiking times that cannot be predicted by any calculator.

4.3 Service Availability

We reserve the right to:

  • Modify, suspend, or discontinue the Service at any time without notice
  • Impose limitations or restrictions on usage
  • Block access for abuse, violation of these terms, or any other reason
  • Change features, functionality, or availability of the Service

5. Limitation of Liability

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIKECLOCK AND ITS CREATORS, CONTRIBUTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

  • Personal Injury or Death: Any injuries, accidents, or deaths resulting from hiking or outdoor activities planned using the Service
  • Property Damage: Loss of or damage to equipment, vehicles, or other property
  • Damages: Any direct, indirect, incidental, special, consequential, or punitive damages
  • Lost Profits or Data: Loss of profits, revenue, data, use, goodwill, or other intangible losses
  • Third-Party Claims: Claims arising from your use of shared links or information

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow limitations on liability for personal injury or incidental/consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

6. Intellectual Property

HikeClock, its design, code, content, logos, and branding are owned by or licensed to us and are protected by copyright, trademark, and other intellectual property laws.

6.2 Your Limited License

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes. You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service
  • Create derivative works or competing products based on the Service
  • Remove, alter, or obscure any copyright notices, trademarks, or branding
  • Use the Service's name, logos, or branding without written permission

6.3 Public Domain Formulas

The mathematical formulas used by HikeClock (Naismith's Rule, Book Time, Tobler's Function, etc.) are based on public domain knowledge. Our specific implementation and presentation are original works.

7. Links and Third-Party Content

The Service may contain links to third-party websites, resources, or services. We do not endorse and are not responsible for:

  • The content, accuracy, opinions, or functionality of external websites
  • Privacy practices or terms of service of third-party sites
  • Products, services, or information offered by third parties
  • Any damages or losses caused by use of third-party content

Access to and use of third-party links is at your own risk.

8. Indemnification

You agree to indemnify, defend, and hold harmless HikeClock, its creators, operators, and service providers from and against any and all claims, liabilities, damages, losses, costs, expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your hiking activities, decisions, or related incidents
  • Any content you share or distribute using the Service

9. Governing Law and Disputes

9.1 Governing Law

These Terms shall be governed by and construed in accordance with applicable federal laws and the laws of the jurisdiction where the Service operates, without regard to conflict of law provisions.

9.2 Dispute Resolution

Any disputes arising from these Terms or use of the Service shall first be resolved through good faith negotiation. If negotiation fails, disputes will be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.

10. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

11. Entire Agreement

These Terms, together with our Privacy Policy and Safety Disclaimer, constitute the entire agreement between you and HikeClock regarding use of the Service and supersede any prior agreements.
